AMD Pandora Official Rules

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility
The AMD Pandora contest (the "Promotion") is open only to legal residents of the fifty (50) United States (including District of Columbia) and Canada (void in Quebec) who are at least eighteen (18) years old at the time of Entry. Void in Guam, Puerto Rico, the U.S. Virgin Islands, other U.S. territories and possessions, and Quebec and where prohibited by law. Employees of Advanced Micro Devices, Inc., Launchfire, Inc. or any of their respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Promotion and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Administrator's decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Promotion will consist of a Contest (“The Contest”)

2. Sponsor and Administrator
Sponsor is Advanced Micro Devices, Inc., 5204 East Ben White Blvd., Austin, TX 78731. Administrator is Launchfire, Inc., 200 Isabella St., Suite 500 Ottawa, ON K1S 1V7  

3. Timing
The Promotion begins on November 3, 2008 at 10:01 a.m. Eastern Time ("ET") and ends on, January 5, 2009 at 10:00 a.m. ET (the "Promotion Period"). Administrator's computer is the official time keeping device for this Promotion.

4. How to Enter
During the Promotion Period, visit www.winwithamd.com (The Promotion Site) and fill out the online Registration form completely by providing your name, state or province, phone number and email address, and submit the form. You will automatically be entered with two (2) Guesses of how many “trapped creatures” are inside Pandora’s Box. Guesses constitute entries in the contest for the purpose of determining potential winners. Limit: one Guess per person, per household, per email address, per day during the Promotion Period for registering. Limited to one (1) subscription per person/Registered User during the Promotion Period.

5. How to earn additional guesses:
A) Visit the Site Daily
Each day you visit the site during the promotion period, you will receive one (1) additional Guess.
B) Sign up to receive the AMD Gamer newsletter
You will receive five (5) additional Guesses for opting-in to subscribe to the sponsor’s newsletter.
C) Invite a Friend Email
You will receive 1 Guess for each of the first ten emails you send using “Invite A Friend”(up to a maximum of 10 Guesses); 1 Guess for each of the first ten recipients who visit the Site as a result of your “Invite a Friend Email”(up to a maximum of 10 Guesses);
3 Guesses for each of the first ten recipients who register for the Site as a result of using “Invite a Friend Email”(up to a maximum of 30 Guesses);

D) Personal Link
The entrant will receive 5 extra Guesses for directing third parties to the Site via your Personal Link (up to 50 Guesses). To retrieve your Personal Link, click on the “Invite a Friend” link and locate the Personal Link or Personal Banner on this page. The distribution of your Personal Link is at your discretion, subject to the following: AMD reserves the right to cancel and void any Personal Link, and all associated Guesses, which it deems, in its sole discretion to be used or associated with content which is deemed inappropriate. Without limiting the foregoing, such content includes all forms of pornography, inappropriate language and content that incites hate, is demeaning, depreciates the value of the AMD name, brand, products or trademarks, or incites discrimination of any and all forms. By way of example, an entrant may wish to post his/her link on instant messenger, blogs, message boards and personal web pages or in emails.

E) Register for http://game.amd.com (The AMD Gamer Site) OR Login to your existing AMD gamer account.

If you are not already a member of AMD Gamer:
Click on the link to http://game.amd.com located on the Promotion site home page or on the Promotion site Earn More Guesses page. You will be directed to the home page of (The AMD Gamer Site.)

Register by filling out the registration form completely with your name, email address, phone number, country, state/province, and zip/postal code and clicking submit.

Once you have completed the registration form the site will send an email to the email address you provided when you registered. Click on the link provided in the email. This will direct you back to the AMD Gamer Site, validating your registration. The page you will be directed to via the link in the email will have a link to the Promotion Site. When you click this link, if you have already registered for the Promotion you will be awarded five (5) Guesses for registering for the AMD Gamer Site.

If you have registered for the contest and are already a member of AMD Gamer, Login to your account at the AMD Gamer site and click on the contest banners directing you to the Promotion Site. If you have already registered at the Promotion Site you will receive five (5) additional Guesses.  

Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of Guesses by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's Guesses and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or Guesser. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. All Guesses become the sole and exclusive property of Administrator and will not be returned. Administrator reserves the right to contact entrants and all other individuals whose email address is submitted as part of this promotion.

6. Prizes
There will be 2 Grand Prize packages available to be won, each consisting of a Velocity Micro Edge M40 System (current approximate retail value (ARV): $1699.00) and a copy of the game Legendary by Gamecock Media Group for Windows Vista/XP (current ARV: $49.99) Total ARV of each Grand Prize Package: $1748.99)
There will be Three (3) First Prizes Each consisting of a copy of the game Legendary by Gamecock Media Group for Windows Vista/XP (current ARV: 49.99)
One prize per person. No cash equivalent for the prizes, prizes are non-transferable and no substitution will be made except as provided herein at the Administrator's sole discretion. Administrator reserves the right to substitute any listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a prize depend on the number of eligible Guesses received during the Promotion Period. TOTAL ARV OF ALL PRIZES: $3,647.95

7. Winner Selection:
A) 1 Grand Prize Package will be awarded to the participant who, the Administrator or an independent judging agency determines guessed the correct number of “trapped creatures” in the 3-Dimensional Pandora’s box. This determination will be made after the close of the Promotion Period on or about January 5, 2009.
If more than one participant made a correct guess, the prize will be awarded based on a random draw of all participants who guessed correctly.
If no participants guessed correctly, the prize will be awarded to the participant who came closest to guessing the correct number without exceeding the correct number.

In the event of a tie in the awarding of a prize to the participant who made the closest guess, the prize will be awarded in a random draw of all the participants who tied.
B) After the determination of the eligible winners in section A, One Grand Prize Package will be awarded to the participant who referred the eligible winner to the Promotion via their Invite a Friend email or Personal Link. If the winner of the prize awarded under section A above was not referred to the contest by another participant, the prize will not be awarded.

C)One (1) First Prize will be awarded to each of the three entrants selected in a random draw of all eligible entries received during the promotion period.
Potential winners will be contacted using the email address provided upon Registration and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules.) Administrator’s decisions as to the administration and operation of the Promotion and the selection of potential winners are final and binding in all matters related to the Promotion.

8. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY ADMINISTRATOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.

9. Verification of Potential Winners
Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winners will be notified by email, telephone, or registered mail after the date of random drawing. The potential winners will be required to sign and return to Administrator, within seven (7) days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize if applicable. If a potential winner of any prize cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner of a prize is disqualified for any reason, Administrator may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. In addition to these requirements, potential winners who are residents of Canada will be required to correctly answer a mathematical skill-testing question without any assistance in order to receive a prize.

10. Entry Conditions and Release
By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Administrator and/or the Contest judges which are binding and final in all matters relating to this Contest; (b) release and hold harmless the Sponsor and the Administrator and each of their respective parents, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest and Promotion, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's Entry, creation of an Entry or submission of an Entry, participation in the Contest and Promotion, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of Entry; and (c) indemnify, defend and hold harmless the Sponsor and the Administrator from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrant’s participation in the Contest and Promotion and/or entrant’s acceptance, use or misuse of prize.

10. Publicity
Except where prohibited, participation in the Promotion constitutes winners consent to Sponsor's and its agents' use of winner's name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

11. General Conditions
Administrator reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Administrator's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Administrator in its sole discretion. Administrator reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the Entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages from any such person to the fullest extent permitted by law. Administrator's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

12. Limitations of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of Entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant's Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another Entry in the Contest, provided that if it is not possible to award another Entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible Entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

13. Disputes
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Texas State Court located in Austin, Texas; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses , and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.

15. Promotion Results
Winners’ names will be posted at game.amd.com
